Examples of Paid Partnerships within live streams include:
1. A user, whether a creator or a brand, has received or may receive compensation for a live stream, which may take the form of monetary payment, gifts, products, or other rewards.
2. A live stream is prepared as part of, or in affiliation with, a commercial agreement, such as a current or recent 'brand ambassador' partnership.
3. A live stream features an affiliate link or discount code, offering potential benefits, incentives, or rewards to the user.
To maintain transparency, any live stream that constitutes a Paid Partnership must include clear and prominent disclosures indicating its commercial nature, with the hashtag #Sponsored, #ad, and/or #PaidPartnership in the description. Failure to provide adequate disclosure may lead to enforcement actions. Follow these simple disclosure rules:
Disclosure of Sponsored Content Requirements
General Disclosure Obligation: The Creator agrees to disclose any sponsored content, paid promotions, or material relationships with brands, products, or services during their live streams on the Platform.
Clear and Conspicuous Disclosure: Any disclosure of sponsored content must be clear, conspicuous, and easily noticeable to viewers. This includes but is not limited to using hashtags: #Sponsored, #ad and/or #PaidPartnership, and verbally disclosing the sponsorship at the beginning or throughout the live stream.
Location of Disclosure: The disclosure must be prominently placed within the live stream, ensuring that it is visible and understandable to viewers.
Duration of Disclosure: The disclosure of sponsored content must remain visible or audible for the entire duration of the sponsored segment of the live stream. It should not be hidden or obscured at any point during the live stream.
Consistency in Disclosure: The Creator agrees to maintain consistency in their disclosure practices across all sponsored content on Vinivia. This includes adhering to the same disclosure methods and language.
In addition to complying with Vinivia Community Rules and Principles , participants in Paid Partnerships, including creators and brands, bear the responsibility of compliance with all relevant laws and regulations, including advertising laws and, where applicable, FTC regulations such as the FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising.
Given the evolving nature of regulations, it is essential to stay updated and ensure compliance with the latest rules and guidelines in the respective country.
